Residency for the parent of a child born in Argentina

A child’s birth in Argentina, the registration of that birth, the child’s ID and passport, and the foreign parents’ own immigration status are four different procedures. A family link can matter to the DNM, but it does not by itself grant residency, citizenship or any guaranteed result. This page is general information, not legal advice.

What the DNM says about the parent

The DNM describes a temporary residency for the parent of an Argentine citizen (native, naturalized or by option) under article 23, subsection ñ of Law 25.871, as amended by DNU 366/2025. You must be in Argentina to apply. The documents it lists include a valid passport; the Argentine criminal record certificate (integrated in RaDEX); criminal record certificates from countries where you lived more than a year in the last three years; proof of address and of regular entry; a legalized birth certificate proving the parent-child link; and the child’s identity document. Foreign documents need legalization or apostille and, if not in Spanish, a certified translation. Because the sponsor is Argentine, the permit is described as an authorization to stay for up to three years. The procedure starts in RaDEX (registration, form, fees, upload) and ends with an in-person appointment. The page was last updated on 30 September 2025; check the fee table on the day you apply.

Does an Argentine child give the parent citizenship?

No, not automatically and not a passport. Decree 3213/1984 article 3(f) lists having a native-born Argentine child among the grounds for naturalization regardless of the length of residence, but how it applies after DNU 366/2025, and what a 2026 court ruling on the citizenship procedure means in practice, is not yet settled and has to be checked for your file. See our citizenship guide and the page on marriage and registered union.
